Given the information the prosecutor had, it's very odd she went for 2nd degree murder. Any defense lawyer will be able to use the broken nose, lacerations, and now potentially offensive wounds on Martin to mount a substantial argument.
The state will have a hell of a time proving depraved mind for a 2nd degree murder conviction.
