In California I believe they ask if you have ever been declared mentally incompetent, should be the same elsewhere.

Yeah, the firearm transfer/purchase application is the same in all states because the criteria for banning gun ownership is national.

Question 11f asks if the applicant has ever been adjudicated (ruled by judge) as mentally ill OR been committed to a mental institution.  

According to the FOX story posted upthread, Katz spent time in the hospital for mental illness when he was younger.  

But, it's not clear that he was ever adjudicated as mentally ill or ever been committed to a mental  institution.  If either occured and the court or the facility didn't report it to NICS, it's another break in the system.  If neither occured and he wasn't addicted to illegal drugs, the purchase was legal.

In any case, he sure didn't have any business possessing firearms.

Another update regarding the Jacksonville shooting.

David Katz carried out his killing spree at the Jacksonville Landing complex Sunday armed with two handguns, both purchased legally in Maryland less than a month ago.

Katz, who killed two fellow gamers before taking his own life, had two guns on his person — a .45 and a 9mm pistol — when he opened fire, leaving 13 victims in his wake.

Katz used only one of the two handguns during the shooting, and it was equipped with a legally purchased aftermarket laser sighting device, Jacksonville Sheriff Mike Williams said at a press conference.

Purchasing a firearm at a licensed dealer means Katz would have had to pass an FBI background check that would have reviewed his criminal history.

Under federal law, people are prohibited from purchasing firearms if they are convicted felons; have a history of illegal drug use; have been adjudicated as mentally ill or involuntarily committed for mental health treatment; are classified as fugitives; or have been convicted of domestic abuse.

Omar Enrique Santa Perez, 29, ^ was identified by police as the man who opened fire at Fifth Third Bank in downtown Cincinnati at around 9.10am Thursday, killing three and injuring two others before being shot dead.

Santa Perez reportedly has a criminal record consisting of mainly low-level offenses such as entering or refusing to leave the premises in Greenville, South Carolina; marijuana possession in Palm Beach, Florida; traffic offenses in Lake Worth, Florida; traffic offenses in Deerfield Beach, Florida; and disorderly conduct in Coconut Creek, Florida. 

None of those offenses are felonies and police believe he purchased the 9mm semi-automatic pistol  legally. 

Perez, who neighbors describe as reclusive and bitter, was armed and wearing a business suit when he somehow made his way into the bank's loading dock, after visiting several nearby stores.

Officials said the outcome of the attack could have been even more tragic if it were not for the actions of responding police officers, given that Perez was armed with multiple magazines and 200 rounds of ammunition.  

Police confirmed that Santa Perez never worked at the bank and doesn't appear to  have any connection to the victims.  They don't believe the shooting was an act of work place violence or terrorism and are investigating the possible motive.

The Hamilton County Coroner’s office has identified the victims as 25-year-old Pruthvi Kandepi, 48-year-old Luis Calderon and 64-year-old Richard Newcomer.  Rest in Peace.

Whenever I have banking actions to do, my better half keeps telling me to use the 'Drive through" window option. 
As I like to go into the bank and process the transactions inside.
She keeps saying with all the unstable people out there, it would be safer for me! Maybe she's right!!
(Especially since in my bank, there's hardly ever anyone in the bank except for the tellers. And me!)

Three active shooters in 24 hours is insane.

The Rite Aid shooter shot 6 people, 3 of them fatally, before shooting herself.  A source close to the investigation said she was a disgruntled employee. 

Sheriff Jeffrey Gahler told reporters the woman was a temporary employee and showed up for work at her normal time at the facility near Aberdeen.  She shot people outside the building and on the warehouse floor, he said. 

The shooter died at a nearby hospital after shooting herself in the head, he said.

She was identified by the sheriff's office as Snochia Moseley (left), 26, from Baltimore County.

The suspect used a 9 mm Glock pistol and brought several magazines for the gun, Gahler said at a news conference. The gun was hers and was purchased legally, he said.

The sheriff wouldn't release any details about the six victims, saying that their next of kin were still being notified.

I understand when gun advocates claim that the real effort to improve public safety should be aimed at keeping guns from 'crazies'.  

What they don't seem to realize, however, is that these three things have to happen to keep a mentally ill person from waltzing into a gun store and buying whatever they want:  (1) committed to a mental health facility against their will, (2) ruled mentally ill and a danger to self/others by a judge, (3) reported as legally mentally ill to NICS/Feds.

That criteria defined by current gun safety/control law just isn't gonna keep guns out of the hands of most mentally ill people.

Anyway, the Sheriff confirmed that the Rite Aid shooter's family had been increasingly concerned about her erratic behavior for weeks. He did not say whether they contacted LE about it, but I won't be surprised if they did.

So many of the recent mass shootings have been carried out by people who'd been reported as threats (often multiple times), but LE didn't or couldn't legally do anything to forbid them from having guns. That needs to change.

I'm interested to know if there's any effort to get the "Red Flag" federal law which Trump previously supported passed. I doubt it, but hope so. I don't agree with Trump that due process should be waived, but I do support having a law which will allow LE to take guns away from reported dangers to society (with a very quick sign-off of probable cause by a judge).

This winner shot two people to death at a Kroger's store today.

He is 51-year-old Gregory Alan Bush.

At a news conference Thursday, Jeffersontown Police Chief Sam Rogers said surveillance video shows the suspect tried unsuccessfully to enter the First Baptist church in Jeffersontown. 

The church is headed by a black pastor and has a large African-American membership.

An arrest report says Bush then walked into the Kroger store outside Louisville, pulled a gun from his waist and shot a black man in the back of the head, then kept shooting him multiple times “as he was down on the floor.”

The report says Bush then reholstered his gun, walked outside and killed a black woman in the parking lot.

A man carrying a concealed weapon who happened to be in the parking lot challenged Bush, and police say the suspect then “began firing wildly” at him, putting other shoppers in the parking lot in danger. 

Neither man was hurt in that confrontation, Rogers said.

Suspect Bush, who the sheriff said had a history of mental illness, was jailed on $5 million bond Thursday on two counts of murder and 10 counts of felony wanton endangerment.

Ed Harrell was quoted by the Courier Journal of Louisville as saying he was waiting on his wife in the parking lot when he heard gunshots and grabbed his revolver.

As he crouched down, he said he saw the gunman walk “nonchalantly” by with a gun by his side. Harrell said he called out to ask what was going on, and the gunman replied: “Don’t shoot me. I won’t shoot you. Whites don't shoot other whites."

The FBI announced that it “is evaluating the evidence to determine if there were any violations of federal law.” (Translation: they are investigating the possibility that this was another race-based hate crime.)

Mayor Greg Fischer said Thursday he's "sick and heartbroken" that two people were shot to death, and says the tragedy "hit close to home." 

Mr. Stallard was the father of Kellie Watson, who serves in the mayor's office as his chief racial equity officer.

It's not clear to me yet if the victims knew each other or if the shooter knew either of the victims.

WDRB is reporting that Bush had a history of using racist language toward his ex-wife and son and previous encounters with the law.
