GUNS DON'T KILL PEOPLE, OR DO THEY?
Most reps in the house are Mass transplants it's pitiful and they are even trying to sneak in an income tax. Dems just loves them some taxes.

Pappy, what do you think of the "Red Flag" bill? That's the bill that allows LEO's to seize the weapons of those who are perceived to be a threat. I was just reading that one is headed to the desk of Colorado's Gov.

It is unconstitutional. 


"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."   

 Some one has to violate the law BEFORE you can deprive them of their rights, and then ONLY after you prove it in court.

Thought crimes are not illegal; trust me, I have them all the time. I never act on them;  therefore, you can't have my weapons.

I'm not referring to thought crimes, I am considering domestic violence, things of that nature.

Convict the person, then disarm them. Wife beaters deserve what they get; they are on the second to the bottom rung in prison. 

Too many people will take advantage of this law to get even;  it sets a very bad precedent. Who decides? Right now Trump does; that make you feel safe?

I'll stick to the constitution.

Several states have implemented Red Flag laws, which I'm glad to see.  I think President Trump is right to support such laws.

But, it's not the President who makes the decision as to whether a person is a danger to himself and/or others and therefor should be banned from purchasing/possessing firearms.  It's the courts, after hearing a petitioned case filed by family or police.

Too many of the mass and family shooters we've covered were reported to police as dangerous ahead of time, some many many times (like Parkland school shooter Nicolas Cruz).  

However, law enforcement claimed after-the-fact that they had no ability to legally forbid the reported threats from purchasing or possessing firearms because they hadn't yet committed a crime and weren't deemed mentally unfit by a judge.  Red Flags laws can help correct that problem and save lives, in my opinion.  

And, Red Flag laws are not a Constitutional breach, for me............just the opposite.  

The Second Amendment specifies a  "well regulated militia".  Arming people who commit and credibly threaten violence against other members of the "citizens' militia" or members of the general population breaches the "well regulated" stipulation of the amendment.

read Federalist 46; Madison defines the power between State and Local vs the Feds. The right exists so people can defend themselves against the GOVERNMENT.  Who decides you are a danger; some one in the government, and if you don't think the president can exert enormous on them, think again.

The judiciary is a separate branch of government from the Executive/Presidential branch, as you know.

So, if Trump for some crazy reason decides he's gonna interfere in judges' decisions regarding Red Flag petitions, he'll be the one violating the Constitution.

But, I don't think he's gonna get into those weeds anyway.  I don't see any real potential benefit to him personally or politically in doing so, but I do see a lot of potential liability.

The Trump Administration and Republican Senate has already been stacking the courts with young conservative judges.  That might mean Red Flag bans against citizens are handed down by the courts less frequently than they would be otherwise anyhow.

In any case, by your rationale Pappy.............background checks, firearm bans for convicted felons and those deemed legally mentally ill, age restrictions and other such firearm regulations would be unconstitutional as well because they're based on laws passed by the GOVERNMENT.

I understand your arguments, I just don't agree with your rationale or your interpretation/application of the Constitution.

It's being reported that Gunmaker Colt says it is suspending its production of rifles for the civilian market including the AR-15. They say they are not permanently ending production but it is their belief that there is already an adequate supply of sporting rifles on the market. Going forward they are going to concentrate on fulfilling military and law enforcement contracts.
