Under 42 U.S. Code § 300aa–22 - Standards of responsibility, a vaccine manufacturer has immunity as long as the vaccine was "properly prepared and was accompanied by proper directions and warnings", meaning you have to prove negligence.
Under the PREP Act, a person or company is only liable if they are found guilty of "willful misconduct", which is almost impossible to prove.
