Misty Cummings' Cousin Arrested In Tenn. On Drug Charges

Monday, August 9, 2010

ANTIOCH, Tenn. -- Joe Overstreet, the cousin of Misty Cummings who has been connected to the search for missing Satsuma girl Haleigh Cummings, was arrested Sunday in a SWAT raid in Antioch, Tenn., on drug charges.

Another man, Justin Hogue, was also arrested at the home on theft and drug charges. Overstreet was charged with manufacturing marijuana and unlawful use of drug paraphernalia.

Putnam County investigators questioned Overstreet in April about the 5-year-old's disappearance in February 2009. Overstreet told reporters he did not know what happened to Haleigh.

"I can't say nothing about it," he said in April. "I want to say something, but I don't know what to say."

Overstreet was visiting family in Putnam County the night Haleigh vanished. Investigators have said they think he is the key to solving the Haleigh case, which investigators said is now considered a homicide investigation.

St. John's gets a crack at her tomorrow, and she cannot be sentenced as a youthful offender again. 12 34 bye bye misty 105
Under Florida law, youthful offender status can only be granted one time, so if Croslin is sentenced in Putnam County as a youthful offender, she cannot be given the same treatment in St. Johns County.

Croslin faces a minimum mandatory sentence of 25 years for the charges in Putnam County and another minimum mandatory sentence for the charge in St. Johns County.

(CNN) -- Misty Croslin, the last person known to see a 5-year-old Florida girl before she was reported missing on February 9, 2009, faces a sentence of up to 210 years in prison after pleading no contest Monday to unrelated drug charges.

Croslin entered no contest pleas to seven counts of trafficking prescription drugs before a Putnam County, Florida, judge, said Chris Kelly, a spokesman for the state attorney's office. Each first-degree count carries a sentence of up to 30 years in prison.

Croslin has a St. John's County court appearance Tuesday on a single trafficking charge. All the counts stem from a series of incidents between around January of this year, during which Croslin allegedly sold hydrocodone to undercover officers.

Lawyer: Misty Knows Who Took Haleigh
Defense Attorney Says Cousin Took Haleigh In Black Bag

ST. AUGUSTINE — Misty Croslin cowered beneath a sheet and heard the screams of Haleigh Cummings being attacked the night the 5-year-old disappeared, Croslin's attorney said this morning.

Croslin has told investigators she was at the mobile home in Satsuma in Putnam County and heard the attack then heard a van door outside open and close, Robert Fields said following a hearing on a prescription drug charge Croslin faces in St. Johns County.

The five- to six-minute attack happened after Croslin's cousin, Joe Overstreet, who was visiting from Tennessee, came to the mobile home looking for a machine gun belonging to Haleigh's father, Ronald Cummings.

The gun wasn't there, Fields said

"Haleigh was a substitute," he said.

He said Croslin hid beneath the sheet holding 3-year-old Ronald Cummings Jr.

At one point, Croslin saw Overstreet either covering Haleigh with something or putting her in a black bag, Fields said.[/color]

Misty Cummings pleads no contest to drug trafficking charges Tuesday in a St. Johns County courtroom.
ST. AUGUSTINE, Fla. -- As Misty Cummings pleaded no contest to another drug trafficking charge, the attorney for the 18-year-old says she has has told investigators that her cousin put Haleigh Cummings in a black bag and took her away.

Misty's attorney, Robert Fields, said she has told investigators what happened in that Putnam County mobile home the February 2009 night that the 5-year-old disappeared.

Fields said Misty told detectives the day after she was arrested on the drug charges in January that her cousin, Joe Overstreet, and her brother, Hank Croslin Jr., came looking for a semi-automatic machine gun. Since the gun wasn't there, Overstreet took Haleigh as a substitute for the gun, the attorney said.

"According to Misty, Joe took Haleigh while Misty was laying in bed and covered herself up with a blanket," Fields told Channel 4 Tuesday morning outside the courtroom. "They were there for like seven minutes, appeared to be on drugs and Misty says she saw Joe put Haleigh in a black bag and she heard Haleigh scream."

Putnam County investigators have interviewed Overstreet in Tennessee, where he currently lives.

Overstreet was arrested last week on theft and drug charges, but he has never been called a suspect or a person of interest in the Haleigh Cummings case.

ron was sentenced to 15 years this morning.

Ronald Cummings, 26, who pleaded guilty in August, could have faced a maximum of 90 years in prison, but reached an agreement with prosecutors that two of five charges he faced would be dropped in exchange for Cummings testifying in any future criminal trial involving the disappearance of his daughter.

At a 15-minute sentencing hearing Friday morning, the state did not call any witnesses, but Cummings' mother, Teresa Neves, did make a brief, tearful plea for mercy for her son. 34
"He is a good father FOR A FUCKING DRUG DEALER , he has two children," said Teresa Neves. "We might not know where one is, but he has two children."

Crystal Sheffield, Haleigh's mother, and other family members were in the courthouse parking lot after the sentence, crying. They said they were deeply disappointed at the sentence.

Judge Terry LaRue then sentenced Cummings to two 15-year and one seven-year sentence, but will allow the time to be served concurrently. LaRue also sentenced Cummings to pay the $200,000 fine plus court costs, but that could be modified later by a civil judge.

misty was put on a suicide watch according to TV reports, so she either threatened to harm herself after ron was sentenced, or it's a precaution.

i emailed someone there to find out. Police

she's too self-centered to harm herself, if she did it, it would be for effect before her upcoming sentencing.

edit: got an email back, she was in infirmary as a precaution because she was very upset *snicker* after detectives interviewed her friday. not on suicide watch.

edit to add, i just found this:
art harris:
Within hours of Ronald Cummings sentencing Friday, The Bald Truth has learned Misty Croslin began to crack under relentless police questioning—and changed her story again.

Family members and sources close to the case tell me Croslin now claims she lied about her allegation that cousin Joe Overstreet snatched Haleigh to cover up yet another horror even closer to home. During her four hour interrogation Friday, The Bald Truth learned exclusively that Misty Croslin now claims it was her own brother, Tommy Croslin, who came to the trailer that night, took Haleigh and fabricated the cousin Joe-machine gun story.

Then, my sources say, she told police Tommy pressured her to go along with it.

Her attorney, Robert Fields, confirmed she met with investigators, but declined to comment further.

“She told me she kept telling the police if they wanted to know what really happened, they had to get Tommy to talk, that he can tell them everything,” her mother, Lisa Croslin, told The Bald Truth after speaking with Misty.

{THE MOTHER, LISA, IS ANOTHER DRUGGIE, THIEF AND JAILBIRD.}

Sources close to the family and the investigation tell me tell me it was about 1:30 p.m. Friday when the methodical grilling of Ronald’s’ 18 year old ex wife began. Only this time, it was with a well-prepared prosecutor with a fresh set of eyes, veteran state attorney Ed Davis of Daytona. He was there watching as investigators hammered away at the inconsistencies and lies Croslin has told for a year and a half about the night she reported five year old Haleigh Cummings missing in February, 2009.

Then the unthinkable happened. No longer able to hide from her lies, Misty Croslin cracked.

Amid tears, weeping and shaking, she blurted out that her brother, Tommy, did it and knows everything. Towards the end, she was distraught, yelling, and believed to be so shaken, required a brief suicide watch on a jail medical ward.

According to what Misty told her mother, during her interrogation, “she started going crazy, yelling and screaming,” she says, then wound up in the infirmary Friday night. “She wasn’t trying to kill herself, she was just very upset. She wanted to be by herself,” her mother, Lisa Croslin, tells The Bald Truth. “They put her on the medical ward with nurses watching. She said she felt like a squished up orange with no more juice to give.”

Within hours, she was off suicide watch, and “the next morning told me she felt better,” said Lisa.
(note: any nurse or officer can place her on a watch, but only a shrink can remove her from a watch.)

That was Saturday. “She’s scared to death and feeling the pressure. I keep telling her nobody will hurt her where she is, that she needs to tell everything before she goes to court,” Lisa Croslin went on. ”She says, ‘I told ‘em everything I know, Mama, that they need to talk to Tommy because he knows everything.’ Whoever done this, got my daughter so scared, I don’t understand it.”

But her mother was adamanant about one thing: “Whoever did this to Haleigh needs to pay for it, even if it turns out to be one of my children,” she says. “But I still feel like she’s covering up for someone else.”

“Her cousin Joe story is a lie,” her sister in law Chelsea Croslin told me before it came out in her police interrogation Friday. At the time, we hadn’t been shown the basis for her claim, though she cited private letters from Misty and other information she says she wants to provide law enforcement, but has had trouble getting through. “I was trying to tell them, but no one returns my calls,” she says.

today she will be sentenced on 1 count. the youthful offender status will only be afforded to her sorry ass ONCE, either today or the 19th in Putnam:

On Friday, Misty will be sentenced on one count of trafficking in oxycodone in St. Johns County, facing a maximum penalty of 25 years in prison.

She still faces sentencing on seven counts of drug trafficking in Putnam County, where she could face up to 200 years. That hearing is set for Oct. 19.
Prosecutors said she could qualify for a reduced sentence as a youthful offender, since she was 17 at the time of the crime, which could reduce her sentence to between six and 25 years.

i'll post when she receives sentence today.
whatever it is, St. Johns or Putnam county jail will hold her until the Putnam sentencing, then she'll be off to prison from there to serve combined time.

25 years heifer!

During a sentencing hearing that began at 1:30 p.m. Friday, Misty told Judge Wendy Berger that she was raped by two people between the the ages of seven and 14 while she was taking care of her great grandmother. She said that while Ronald Cummings was rough with her, it was an upgrade in her life and she loved him.

Misty faced one count of trafficking in oxycodone in St. Johns County. Later this month, she will be sentenced on seven counts of drug trafficking pending in Putnam County, where she could face up to 200 years.

She took the stand in her own defense, saying that she started selling drugs because she grew up poor. "It is wrong to drug deal, but when you grow up poor, that is what you do," she said on the stand during defense questioning.

She agreed that for the first time in her life, she is in control.

She also was questioned by Judge Wendy Berger who asked her why she should be treated different than her codefendants.

Croslin was arrested earlier this year, along with her ex-husband and Haleigh's father Ronald Cummings. Croslin's brother Hank was also arrested for drug trafficking. Both got 15 years in prison.

"I wouldn't be here if (the FBI) didn't come at me... I'm not a drug dealer," Croslin responded.

Berger disagreed. She pointed at Haleigh's family in the courtroom. "They're here because of Haleigh, you're here because of drugs."

Croslin also asked to be sentenced as a youthful offender. "I'm so young, I have a lot of life ahead of me...."

"But you like the money?" said Berger. "Yes," Croslin responded.

The state argued with Croslin about her involvement in the drug deals; she has persisted that she was not the leader and that the drug contacts were the groups' not hers alone.

She persisted that she was not into pills. "I'm into marijuana; I don't sell it, I smoke it."

Misty Croslin's mother, Lisa Croslin, testified today that she was a "terrible mother." She used drugs, she said, when she was raising her daughter, and that Croslin failed seventh grade, then never returned to school. THE TRAILER TRASH LET HER QUIT IN 7TH GRADE?

Her mother and other family members are sitting behind her in the St. Johns County courtroom, and relatives of Haleigh Cummings are also in the courtroom.

As Misty Croslin became hysterical, her mother also said that she blackmailed her daughter for Xanax during the Haleigh investigation. She testified that she was unsure of her daughter's age, what a PTA is, and whether Misty Croslin can add. UNSURE OF HER DAUGHTER'S AGE??

PUTNAM COUNTY, Fla. -- Misty Croslin won’t be sentenced on charges in Putnam County until 2011, but the last person to see Haleigh Cummings won’t be going far in the meantime.

Croslin was sentenced to 25 years in prison on Oct. 8 on one count of drug trafficking in St. Johns County.

She faces nine charges in Putnam county.

A sentencing hearing was supposed to be held on Oct. 19 on one of the drug trafficking charges, but the sentencing has been moved to Jan. 10, officials said on Friday.

Misty was with Haleigh Cummings, 5, on the night she disappeared in February 2009. Haleigh has not been seen since.

Recently, Croslin reportedly told investigators she heard Haleigh Cummings being attacked before she vanished.

Croslin, who was the girlfriend of Haleigh's father, Ronald, at the time, was arrested with the child's father in a drug sting.

Ronald has also been sentenced to 15 years on similar drug charges.
